Proposed waiting period for repeat attempts to pass a bond or levy

If passed, legislation would require taxing districts to wait a full year before placing a failed bond back on the ballot.

One lawmaker wants to limit how often a failed bond or levy can reappear on the ballot.

The legislation would apply to all taxing districts and all cities, counties and school districts. They would have to wait a full year before putting a failed bond or levy back on the ballot.

As of now, a measure can be put back in front of voters potentially three times after it has failed.

Rep. Heather Scott says the intent is to stop aggressive taxing districts from running a measure over and over until the desired outcome is achieved.

"When voters say no, they mean no, and at least give them a year before you re-ask them the question," says Scott.

However, some school officials say, if passed, this could make it difficult for districts to get funding.

Scott's bill was voted into print this week. Democratic Rep. Elaine Smith was the only no vote.

The bill is scheduled to have a full hearing with public testimony next week.
